Attorneys and a judge will question a former reality show producer regarding a will contest before his extradition to Mexico, where he faces charges of killing his wife in 2010.
The parties will meet to discuss which of two wills attributed to the woman shall determine legal guardians for the couple's children along with determine how the woman's property is to be distributed.
The hearing over the contested will be held at the Metropolitan Detention Center, the federal jail where the producer of hit CBS reality television show "Survivor" is being housed. The Superior Court judge that called for the preliminary hearing, bringing the man to the courthouse was too much of a security risk.
The man is accused of killing his wife after her body was found near the Moon Palace Hotel in Cancun where the couple was on vacation.
The parties will examine wills created in 2004 and 2008 to determine which one is legal. Sisters of the slain woman argue that the 2004 will accurately represents the slain woman's desires. This document lists one of the sisters as the legal guardian for the couple's children.
However, the couple filed an additional will in 2008 before a trip to Australia. Parents of the accused killer argue that the more current of the two wills trumps the latter.
In a 2010 hearing, the producer's parents testified that their son's wife adjusted the will because she believed one of her sisters would not be a fit parent and the other would be a poor executor of her estate.
